These are the terms of use ("Terms of Use") for the Regency Centers website ("Site") which govern your use of the Site and compliance with these rules is a condition to your use of the Site. If you do not agree to be bound by the Terms of Use, promptly exit this Site.

Ownership of the Site

All pages within this Site and any material made available for download are the property of Regency Centers. The Site is protected by United States and international copyright and trademark laws.

The contents of the Site, including without limitation the text, site plans, images, audio, and video, and any materials accessed through or made available for use or download through this Site may not be copied, distributed, modified, reproduced, published or used, in whole or in part, without the prior written consent of Regency Centers, except that you may download content from the Site to any single computer for your personal or internal business use only, provided you keep intact all copyright, trademark, and other proprietary notices and comply with any applicable end user license agreements. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal or internal business use (but not for resale or redistribution).

You may not frame or utilize framing techniques to enclose, or deep linking to, any name, trademarks, service marks, logo, site plans, content or other proprietary information (including; images, text, page layout, or form) of Regency Centers without our express written consent.

Tenant Submissions

Our site permits submission of information from our tenants. In the event you are a tenant and submit information to us through our Site, all such submissions shall be governed under the terms and conditions of your Lease, as supplemented by these Terms of Use. In the event of a conflict between your Lease and these Terms of Use, the terms of your Lease shall prevail. Nothing on our Site shall be deemed an offer to contract by Regency, and any submissions, proposals, requests or offers made by you through this Site, shall be binding on Regency Centers only to the extent Regency agrees in a separate written agreement.

No Lease Modifications

The landlord tenant relationship between Regency Centers and its tenants shall be governed by and under the Lease Agreement between the parties (the “Lease”). Neither these Terms of Use, nor any statements, representations, warranties or other communications on or through this Site or other Regency provided or affiliated sites, such as the Regency Yammer site or online payment site (collectively, “Regency-Affiliated Sites”) shall modify, amend or alter the Lease in any manner. Except for Terms of Use, Privacy Policies and other legal terms and conditions provided by Regency, no communications, messages, statements or information on the Regency Yammer site shall be contractually binding on Regency. Regency will only be contractually bound to the extent Regency executes a written legally effective amendment to the Lease, or other legally enforceable agreement separate from communications, messages, statements or information on the Regency-Affiliated Site.

Online Payments

Tenants can access Regency Center’s Payment Center site through Regency's Payment Center Portal. At the Payment Center, tenants can make payments through U.S. bank checking accounts via Automated Clearing House (ACH) transactions. If you enroll to make recurring payments automatically, all rent, charges and fees will be deducted from the bank account you designate during the setup process. If you want to designate a different account or if there is a change in your account, you must change your information online. This may temporarily delay your ability to make online payments while we verify your new payment information.

You represent and warrant that if you are making online payments (i) any bank account information you supply is true, correct and complete, (ii) you will maintain sufficient funds in your bank account to pay all charges, (iii) you will pay the charges incurred by you in the amounts posted, including any applicable taxes, and (iv) you are the person in whose name the account was opened and you are authorized to make payments from the applicable bank account.

If the electronic payment transaction is returned unpaid due to lack of available funds, you agree to deposit sufficient funds immediately to your linked checking account to cover any overdraft. Regency Center’s reserves the right to charge a service fee - at a rate allowed by your state of residence - for any transaction that results in a returned item due to insufficient funds. When you set up electronic payments, you hereby consent to the following:

• Provide Regency Centers all required enrollment data, including bank account information associated with the check card, in case it is necessary to debit or credit the account for correction of errors;
• Give permission for Regency Centers to, directly or through third parties, access your checking account to apply debits and credits to correct errors.

Accuracy and Integrity of Information

Regency Centers makes various information available through its Site, including information relating to properties for sale and lease by and through Regency Centers. Site plans, maps, dimensions, photographs and other similar property related information are presented solely for the purpose of identifying the approximate locations, sizes and other dimensions of property and buildings. This information may be estimates of current conditions or conditions contemplated in the future by Regency Centers or other property owner. Building sizes, site dimensions, access and parking areas, existing tenant locations and identities are subject to change without notice and at the discretion of Regency Centers, other property owners or tenants. Unit numbers as indicated are not necessarily the actual suite numbers and are intended for use as a reference only.

Although Regency Centers attempts to ensure the integrity and accurateness of the Site, it makes no guarantees whatsoever as to the correctness or accuracy of the Site. It is possible that the Site could include typographical errors, inaccuracies or other errors, and that unauthorized additions, deletions and alterations could be made to the Site by third parties. In the event that an inaccuracy arises, please inform Regency Centers so that it can be corrected. Information contained on the Site may be changed or updated without notice.

Disclaimer of Warranties

REGENCY CENTERS DOES NOT WARRANT THAT ACCESS TO OR USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN THE SITE WILL BE CORRECTED.
